English Abstract

A Study on the Legal Problems of the Regime of Recruitment of Public Servants in Macao Special Administrative Region Abstract The thesis aims to study and discuss the legal regime of recruitment of public servants in the Macao Special Administrative Region. The thesis is divided into five chapters. Chapter I introduces the background and purpose of the study, and related research methods. Chapters II and III are the main parts of the thesis. Chapter II introduces the history and evolution of the regime of recruitment of public servants in Macao. Section I mainly shows the procedures of recruitment in various periods before and after the establishment of the Macao SAR; and section II compares the procedures of recruitment in various periods and suggests improvements for the current “Regime of standardized management external examinations”. Chapter III describes the evolution of the recruitment of Macao public administrative staff. Sections I and II of Chapter III introduce the forms of appointment stipulated by the “Regulations on Workers of the Public Administration” (ETAPM), approved by Decree-Law n.º 87/89/M, before and after the entry into force of Law n.º 12/2015; Section III shows statistics on current public officials of the Macao SAR Government; Section IV compares the welfares between the staff recruited under administrative recruitment contract, which comes from the entry into force of Law n.º 12/2015, and the staff recruited under the contract stipulated by the old regime; Section V compares the welfares between the staff recruited under administrative recruitment contract and the staff recruited under the regime of definitive nomination; Section VI brings up other issues concerning the recruitment of public servants. Chapter IV proposes perfect countermeasures against the problems and legal loopholes explored in the previous chapters. Chapter V is the conclusion of the thesis. It is hoped that the Macao SAR government will pay more attention to the regime of recruitment of public servants and review the implementation of relevant regime on a regular and timely basis. 澳門特別行政區公務人員聘任制度法律問題研究 摘要摘要摘要摘要 本文旨在對澳門特別行政區公務人員聘任法律制度進行研究及探討。 本文共分五章,第一章首先會介紹本研究的背景和目的,以及相關的研究方 法。 第二章及第三章是本文的重點部份。第二章介紹澳門公務人員招聘制度的歷 史沿革,第一節主要帶出澳門特區成立前後各個時期的招聘程序;第二節則比較 各個時期的招聘程序及對現行的「統一管理對外開考制度」提出改善建議。 第三章介紹澳門公共行政工作人員任用方式的演變,頭兩節介紹在第 12/2015 號法律生效前後,配合第 87/89/M 號法令核准的《澳門公共行政工作人 員通則》所規範的任用方式;第三節展示有關特區政府現行公務人員的統計數字, 第四節將對第 12/2015 號法律生效的產物——行政任用合同與舊有的編制外合同 及散位合同人員權利之間作出比較;第五節則對行政任用合同制度與確定委任制 度人員權利之間的進行比較;而第六節則帶出公職任用方式的其他問題。 第四章會對上數章發現的問題和法律漏洞提出完善的對策,而第五章則為本 文的結論部分,期望特區政府對公務人員聘任問題加大重視,定期且適時檢討有 關制度的實行。 關鍵字:公務人員,聘任制度,招聘程序,任用方式
