Under the background of the increasingly common phenomenon of commercial use of personality rights, the protection in economic value of personality rights has become an inevitable trend of human social civilization and legal progress, and it is also a new problem in the field of civil law. In addition to the introduction and conclusion, this paper is divided into six chapters: The first chapter defines the concept of economic value on personality rights. 21 世纪是一个全面高速发展的时代，人权主义理念在不同的社会文化之中均得到了更多的关注与认可。在人格权商业利用现象愈发普遍的时代背景下，人格权上经济价值的保护已成为人类社会文明与法律进步的必然趋势，也是我国民法领域面临的新问题。 本文除导论与结语外共分为六个章节：第一章对人格权上经济价值的概念问题进行了相关的界定。选择了“人格权上经济价值”这一术语，并对其概念与特征进行了简要介绍；第二章与第三章则以不同年代下的相关判例为线索，分别介绍了美、德两国关于人格权上经济价值的保护模式，即德国法通过扩张既有人格权的内涵、使其同时包含经济价值，并借助人格权的具体规则对其进行保护的一元保护模式与美国法通过在隐私权之外创设独立的公开权，实现人格权上经济价值的法律保护的二元保护模式。本文的重点章节为四、五、六章：第四章着重对美、德两国关于人格权上经济价值的保护问题进行了比较研究，找出了二者间的基本共识与主要差异，并分别就其是否具有引入我国民法的可行性进行了分析；第五章通过不同的案例分析人格权上经济价值在我国司法与立法上的现状及存在的一些问题，进而在第六章中结合之前域外法的比较分析对人格权上经济价值的性质进行界定并明确相关利用方式与救济方式，为完善我国人格权上经济价值的保护制度提出相关的建议。 我国现行法律对人格权上经济价值的保护存在着一些空白与盲区，还需在未来进行一定的努力才可以使得这种权益得到更加有效的保护。本文选择德国法与美国法这两个非常具有代表性的国家作为域外法律模式比较研究的对象，学习与借鉴其中有益的立法经验，希望可以为人格权上经济价值在我国法律体系中寻求一种合理的保护模式。 关键词：人格权，财产利益，公开权，人格要素
