Title

A legal study of air passenger rights and civil air transportation liability under the international and regional liability regime

English Abstract

Abstract The synergy gained from rapid growth of air transportation obtained a good result of increasing demand for passenger protection. The current legal system on air carrier liability gave explicit rules for damages claims in case of air accident which increased transparency and accountability at domestic level and international level, but still not able to encompass all dispute cases, the current customer protection law is lacking of detailed information, even in the well-developed consumer protection system country such as the United States or the European Union. The ambiguous provisions result in a certain degree of loophole dejects victims’ legal action, At the same time, the redundant rules in various legal instruments may result of overlapping interpretation and, conflicting obligations and liability. In order to discover what extent the legislation could boost certainty and enhance confidence to the current and potential contracting states, this thesis would also examine the objective of the existing international conventional law and how much it has been achieved, and surely, I will also examine the overlapping areas between the Warsaw-Montreal system and other the applicable regulation. Eventually, this thesis is aimed to forecast future tendency of passenger protection in air transport.
