Title

Application of competition law to the shipping industry in China

English Abstract

In past decades, the shipping market was subject to special rules by its special position. The shipping companies gathered to form horizontal agreements (e.g. price fixing agreements and rationalization agreements) or cooperation (e.g. the liner conference, liner consortia). These agreements not only brought the commercial benefits to the shipping companies, but also brought the challenges to fair competition and to legislators to consider how to regulate competition in the shipping industry. The European Community performs a leading competition legal system to regulate the shipping industry, in which the most specific rules refer to the block exemption to liner conference and liner consortia. We know China owns a considerable amount of the international trade market, in which a great portion of imports and exports rely on the ocean transportation. However, the weak competitiveness of domestic shipping companies leads to the international shipping market in China being largely occupied by foreign shipping companies, the unfair price competition or their large market share may possibly restrict or eliminate the competition in market. Although China has the general competition law like Anti-monopoly law (AML) and the specific shipping regulations to regulate the competition in shipping industry, the effectiveness of current legal system needs to be rethought. My thesis will make effort to analyze the applicability of the current competition law to the international shipping industry in China, and also research on the problems of the current legal system and make suggestions on how to solve the problems.
