Intellectual property rights protection of entertainment industry in cyberspace

English Abstract

The Entertainment industry as a core copyright-based industry is heavily dependent on intellectual property rights, in which effective protection of intellectual property rights plays a vital role in bringing huge commercial value and economic growth in the world. However, the rise of cyberspace and the advancement in information technologies have changed the entertainment industry a lot in the digital age. Cyberspace has given a new platform for the industry to develop innovative avenues of offering entertainment services and tap into a wide range of global markets. At the same time, cyberspace is a double-edged sword for the entertainment industry. While many attractive opportunities have been offered by the cyberspace, challenges and problems have sprung along with it. Cyberspace has become an unruly terrain of intellectual property rights infringement(especially copyright infringement).Numerous reasons could be attributed to the proliferation of intellectual property rights infringement in cyberspace, like ease of access to the Internet, nearly zero cost to upload and download digital files, unconscionable sharing of digital content illegally, difficulty to trace violators in the Internet, differences in national legislation over intellectual property rights protection, etc. Effective solutions from international or national legal regimes are urgently needed in this situation to manage these challenges. This thesis identifies the major intellectual property rights challenges facing entertainment industry in cyberspace and examines various possible solutions that could be provided by international or national legal regimes to fight against the intellectual property rights infringement acts. The thesis first identifies the various opportunities and challenges that are related to intellectual property rights protection of entertainment industry in cyberspace. Then, the thesis investigates different intellectual property rights protection provided by different international and national legal regimes. In the end, the thesis discusses the possible solutions to improve the intellectual property rights protection for a sustainable growth of the entertainment industry in cyberspace. 【Key Words】Entertainment Industry, Cyberspace, Intellectual Property Rights Threats, Copyright Infringement
