"網絡預約出租汽車經營服務管理暫行辦法" 及其地方實施細則的行政法評析 = A critique of "Interim Measures for the Management of Network Reserved Taxis" and local implementation regulations from the perspective of administrative law

English Abstract

To a certain extent, Network reserved taxis solve the public travel problems and enhance the quality of public travel services. However, in the face of the development of the network reserved taxis, traffic control departments did not make an efficient response, leading to a negative impact on the management of the city road order. The over-supply of the network reserved taxis caused road resources more stressful pressure. The network reserved taxis seriously affected the parade taxi company's business, the country has repeatedly appeared parade taxi driver collective outage. Local traffic control departments usually use uncivilized law enforcement. It leads to a number of mass violent incident, disrupting the normal road transport market order. "Road Transport Ordinance" provides that operators engaged in the operation of road transport must obtain the business license. In order to promote the legitimate business of the network reserved taxis, the Ministry of Transport has formulated "Interim Measures for the Management of Network Reserved Taxis". On the basis of strict enforcement of administrative legal norms, the Ministry of Transport makes the maximum reform, puts the network reserved taxis into the taxi management system ,for taxis sets "network reserved taxi business license "," network reserved taxi transport license "," network reserved taxi driver card ". In Beijing and some large or medium-sized cities network reserved taxis implementation regulations, the addition of license conditions that Limit the driver's and vehicle’s household registration violates the law. In addition, the vast majority of cities in the local network reserved taxis implementation rules set up the vehicle wheelbase, displacement, length and other aspects of strict licensing conditions, do not meet the reasonable administrative principles. The behavior of traffic control departments set some illegal or unreasonable licensing condition leads to a possibility of using the power to maintain the vested interest groups and prevent the development of new market participants. In view of the administrative legislation activities, the Ministry of Transport has the shortcomings of insufficient legal authority, and discretionary power of the local traffic control departments is unfair. Once use "Interim Measures for the Management of Network Reserved Taxis" and local network reserved taxis implementation rules, the strict licensing conditions will result in a significant reduction in the number of vehicles and practitioners. Network reserved taxi company may be like a parade taxi company. How to deal with idle vehicle resources and the cost of managing a large number of illicitly operated vehicles are problems that local traffic control departments still have to face. The author suggests that in order to meet the maximum demand of passengers and to eliminate the shortcomings of the administrative legislation of our departments and local governments, the administrative legislation of should be raised to the level of administrative regulations to set a new regulatory model. Chinese Abstract

网约车,在一定程度上解决了公众出行的难题并提升了公众出行的服务质量。但在面临网约车经营发展的问题上,我国道路运输交管部门没有作出及时高效的回应,导致网约车的发展给城市道路秩序的管理造成一定的负面影响。网约车的过度供给,给我国道路资源造成更为紧张的压力。同时,网约车严重影响了巡游出租车公司的经营发展,全国多地相继出现巡游出租车司机集体停运事件。地方道路运输交管部门通常采用暴力执法、钓鱼执法等不文明的执法方式。由此引发了多起群体性暴力对抗事件,扰乱正常的道路运输市场秩序。 我国《道路运输条例》规定,从事经营性道路旅客运输的经营者,必须取得经营许可资格。为推动网约车的合法经营,交通运输部制定了《网络预约出租汽车经营服务管理暂行办法》。交通运输部在严格执行行政法律规范的基础上,在其法定职权范围内作出最大限度的改革,将网约车纳入出租汽车的管理体系,为网约车设定了《网络预约出租汽车经营许可证》、《网络预约出租汽车运输证》、《网络预约出租汽车驾驶员证》三项行政许可。 北京等大中城市的地方网约车经营实施细则中,增设对从事网约车经营的驾驶人员的户籍限制和车辆的号牌限制的许可条件,违反法律的相关规定。此外, 绝大多数城市的地方网约车经营实施细则中,对车辆车轴距、排气量和车长等方面设定严格的许可条件,不符合合理行政原则。地方道路运输交管部门增设不合法或不合理的许可条件的行为,存在着利用权力维护特许经营模式下传统既得利益集团的利益,阻碍新型市场参与者发展的可能性。 针对网约车的行政立法活动,交通运输部存在法定权限不足的缺陷,地方道路运输交管部门又存在滥用行政自由裁量权的可能性。《网络预约出租汽车经营服务管理暂行办法》和地方网约车经营实施细则一旦实施后, 严格的许可条件将会导致网约车车辆和从业人员大幅度减少,提高网约车的运营成本,抑制了平台公司的市场创新能力。网约车平台公司可能出现巡游出租车公司服务质量低下、体制僵化等弊端。如何处理不符合许可条件的闲置车辆资源,以及管理大量非法营运的车辆的成本,都是地方道路运输交管部门仍需面临的问题。 笔者建议,为满足社会对公共道路旅客运输的最大需求,并消除我国部门及地方政府行政立法的缺陷,网约车的行政立法行为应当上升到行政法规层面,为网约车设定适应新形态、不同于巡游出租车公司的新型规制模式。 关键字: 网约车,行政许可,行政法基本原则
