性騷擾刑事化研究 = Research on sexual harassment criminalizing

English Abstract

Sexual harassment has been existing for centuries. With the progress of the times and better understanding, it was gradually regarded as a universally social problem instead of as individual behavior, which appeals the adjustment of relevant legal system. The problem of sexual harassment in many countries, represented by Europe and the United States, has formed a relatively mature theoretical system and legislative system. However, the study of theoretical and legislative system about this area in mainland of China is comparatively behind. At present, the anti-sexual harassment law or the relevant provisions, which in most countries belongs to the category of social law, provide a variety of remedies for the parties from the perspective of the civil, administrative and criminal. In this regard, this thesis discusses the anti-sexual harassment legislation from the perspective of criminal law. Through a comparative study, case analysis and other methods, the thesis discusses about the definition of sexual harassment, the necessity of sexual harassment criminalizing, the crime constitution of sexual harassment, the criminal responsibility and the relevant supporting system. It also, based on the actual situation of China, proposes amending suggestions of law about sexual harassment crime. This paper consists of four chapters. The first chapter is about the definition of sexual harassment. Firstly, it elaborates the origin and development of the concept of sexual harassment. Secondly, it discusses the feature of sexual harassment. Finally it discusses the classification of sexual harassment. According to different scenes, it is divided into workplace sexual harassment and non-workplace sexual harassment, while divided into verbal harassment and non-verbal harassment according to different behaviors. The second chapter introduces the legislation modes of anti-sexual harassment in the world's major countries and regions. First of all, it introduces the legislation mode of anti sexual harassment in some European countries. Followed by the introduction of the legislative model of anti sexual harassment in China, including Taiwan, Hongkong and Macao. At last, the paper reviews the evolution process of the anti-sexual harassment in history, and suggests the legislative mode based on national circumstances. The third chapter discusses the consideration of sexual harassment criminalizing. The first part describes the relationship between sexual harassment and crime. The second part expounds the basis of the sexual harassment criminalizing. The third part discusses the necessity of the sexual harassment criminalizing. The forth chapter consists of the constitution of sexual harassment crime, the criminal responsibility and the related supporting system, such as the prosecution system, evidence system, etc.

社会生活的发展导致人们的权利意识逐渐增强。性骚扰现象古已有之,一 开始被视为个体行为,随着时代的进步和认识的深入,人们开始逐渐意识到性 骚扰是一个社会问题,具有一定的普遍性,需要相关法律制度予以调整。以欧 美为代表的许多国家对性骚扰这一问题已经形成了相当成熟的理论体系及立法 制度。而中国内地对此的理论研究起步较晚,立法也相对较为疏漏。目前大多 数国家的反性骚扰法或相关条款在性质上属于社会法,其特征即是从民事、行 政、刑事多角度出发,并行不悖地为当事人提供多种救济途径。对此,本文拟 从刑事法的角度为反性骚扰立法提出自己的几点思考。 本文通过比较研究,案例分析研究等方法对性骚扰的定义、性骚扰刑事化 的必要性、性骚扰罪的犯罪构成、刑事责任以及诉讼制度、证据制度等相关配 套制度问题展开探讨;同时结合中国国情,提出关于增设性骚扰罪的法律修改 建议。本文共分为四节: 第一节性骚扰的定义。首先阐述了性骚扰概念的由来及其发展。其次探讨 了性骚扰特征。最后探讨了性骚扰的分类。主要是依据其发生的场所不同,可 以将性骚扰划分为职场性骚扰和职场外性骚扰;根据行为方式不同,将性骚扰 分为言语性骚扰和非言语性骚扰。 第二节介绍了世界主要国家及地区反性骚扰立法模式。首次介绍的是部分 欧洲国家的反性骚扰立法模式,其次介绍的是包括台湾、香港、澳门在内中华 地区反性骚扰立法模式,最后评述了反性骚扰在历史上的演进过程,再提出本 文观点,认为应结合本国国情应当采纳的立法模式。 第三节讨论的是性骚扰刑事化考量。第一部分阐述性骚扰与犯罪的关系。 犯罪行为的本质特征是具有严重的社会危害性,应当根据性骚扰的社会危害性 将其区分为应当刑事化的性骚扰行为和不应当刑事化的性骚扰行为。第二部分 阐述性骚扰刑事化的依据。第三部分阐述性骚扰刑事化的必要性。 第四节的主题是性骚扰罪的犯罪构成、刑事责任及相关配套制度。主要分为 三部分:一是性骚扰罪的犯罪构成;二是性骚扰罪的刑事责任;三是相关配套 制度,例如起诉制度、证据制度等。
