中藥保健食品的市場與監管 : 一項跨區域的比較研究

English Abstract

Abundant Chinese herbal medicines and the long-standing culture of Chinese medicine have provided a solid industrial base for TCM health food products. In this study, the usage of ingredients and function as well as dosage forms of TCM health food products in Mainland China and Taiwan were analyzed comparatively. A crossregional study was conducted among Mainland China, Taiwan, Hongkong, Macau, Japan, USA and EU to compare the definitions, laws and regulations, market situation and herbs using of TCM health food products. The thesis describes the current market and regulations status of TCM health food products. Meanwhile, R&D direction and globalization of TCM health food were discussed. Through multi-angle longitudinal analysis and cross-regional comparison, a market and regulation network of TCM health foods was built. From this network, the current situation and problems of TCM health foods market and regulation can clear be seen. These will guide the R&D direction as well as globalization of TCM health foods. The research found that, Mainland China, Taiwan, Japan and USA have a clearer legal definition on health foods. In Hong Kong and Macau, health foods containing TCM are managed as Chinese patent drugs. Mainland China, Taiwan, Hong Kong and Macau developed specific lists to manage the use of herbal medicine. The difference is that, lists in Mainland China are for health foods, in Taiwan are for all food products and in Hong Kong and Macau are for Chinese patent drugs. In terms of regulatory regime, Mainland China, Taiwan and Japan are similar. These three regions are all take double-track system, that is, registration system and filing system. They particular emphasis on evaluating the functionality and safety of the new products. Mainland China and Taiwan have similar aspects on the usage of ingredients and function as well as dosage forms. In the past decade, the function and the usage of ingredients have no significant change in Mainland China TCM health foods. Modern food science and pharmaceutical technology should be absorbed into health food industry to help R&D process and quality control. In terms of the globalization promotion of TCM health foods, different strategies should be formulated base on policies in different areas. For instance for the EU, Chinese herbs which have already registered in the EU should be given the high priority to develop into health products at the current stage.
