Friendship behavior is a kind of theory that makes up for the deficiency of the traditional theory, which is based on the framework of the law of the German legal system. 情誼行為是在德國法系法律行為理論構架基礎上發展出的一種彌補傳統理論的不足的 一項理論。法律行為的核心是意思表示，而情誼行為欠缺意思表示的構成要件，從而游離 於法律行為的層面之外，不構成法律行為。民法上情誼行為與法律行為的區分，實質上暗 示了自由意志的界限，以及法律強制力所能夠調控的社會關係的範圍。基於節約有限的司 法資源以及有些關係由法律以外的途徑去調整更為合理的考量，有些關係的調整不宜由法 律積極地介入。但非法律行為性質的情誼行為與具有情誼因素的法律行為具有極大的相似 性，現實生活中人們仍舊將情誼行為與具有情誼因素的無償合同混同，這也造成很多涉及 身份的情誼行為，本該屬於情誼行為的純粹生活事實卻不適當地被認定為民事法律行為的 法律事實。 本文在第一章情誼行為概念的界定中重點論述了情誼行為的概念、特性，及其與相關 概念之區分。第二章無償合同的法律特性分為三個部分，第一部分研究無償合同的構成要 素，第二部分延伸出情誼行為與無償合同的區分意義。并在第一部分的基礎上，分析情誼 行為與無償合同的根本區別。大陸法系是從行為構成的角度進行定義，重點在於強調情誼 行為人在主觀上欠缺設立法律上權利義務關係之意思表示；而英美法系則從法律效力的角 度進行界定，亦即強調情誼行為當事人的行為在客觀上並不具備法律之強制力。在第三章 中進一步闡述對情誼行為與無償合同區分時所依據具體標準主觀與客觀標準，從所涉利益 是否重大、行為主體的之間的相互關係及身份與利益需要法律保護的急迫性方面可以將二 者加以界分。具體而言，不同類型的無償合同與情誼行為區別也不盡相同。因此在接下來 一章中，將無償合同類型化與相應的情誼行為相對比，同時比較兩者在法律效果上的差 異，進一步細化闡述兩者區別以及區分的方法。對於兩者的區分要根據具體的案例情況動 態的判斷。最後對文章進行總結。
