In this thesis we will focus on the concept of Administrative authorization, enumerate existing Chinese and local scholars for administrative authorization have different definition, and process deeply analysis on it. Elaborate the advantages and disadvantages of their viewpoints; hence, we can inference the understanding of Administrative authorization from local scholars. Administrative authorization is a legal system means that administrative organizations, on the condition of definite permission of laws and regulations’ by legal rights and procedures, according to the management of administrative practical situation, in accordance of legal procedures, own administrative authorization confer to another administrative organization, the authorized organization will practice the functions and powers by themselves and take the consequences as well. In this concept, ensure that the administrative authorization legal basis authorizing the prerequisites and program requirements, authorized body, content and consequences of authorization. Constitutionalism, as a logical and reasonable platform to reflect on administrative authorization. Believe that all regarding administrative authorization also including the basic theory of constitutionalism. In accordance of administrative authorization theory, I will draws on the power of virtue and contingency theory, in the existing government administrative management, effective management skills based on actual environmental from changed to adjusted. In the same time, economics development and social requirements also changed by time flies. Thus, administrative authorization becomes useful tools for Macau SAR administrative management. In this thesis, Preliminary analysis of Macau administrative authorization rules, existing laws and regulations into the administrative authorization specification fields, and pointed out those different standards, authorized practices and distinguish type etc. in Macau SAR. Classification and comparison of administrative authorization, through practical analysis, found that have 5 issues need to solve it on administrative authorization of Macau SAR, they are, authorized too disperse, lack of completion standard of administrative authorization, poor system of administrative authorization, authorized organization failed to exercise adequate “right of retraction”, the right to control the judicial power of the executive is weak. In the legal system implementation issues regarding administrative authorization, voice out 4 aspects to let the legal system of administrative authorization be completed, including: complete the standard and content of administrative authorization, administrative authorization body and targets, authorize procedures, rights control and inspect.

本文從行政授權的概念分析入手，列舉了目前國內學者及本地學者對行政授權的不同定義，並對它們進行了較為深入的分析，闡述各類觀點中各自的優缺點，由此推論出澳門學者對行政授權概念的理解：行政授權是指行政機關在法律、法規明確規定容許授權的情況下，根據行政管理的實際狀況，按照法定的程序，將其自身所擁有的行政職權授予另一行政機關,被授權機關按此以自己的名義行使該職權,並因此承擔行使該職權所造成的法律行為效果的法律制度。此一概念明確了行政授權的法律、法規依據、授權的先決條件和程式要件、授權的主體、內容以及授權的結果。本人把憲政作為行政授權法理思考的邏輯起點和合理平台，認為一切關於行政授權的基本理論都可以概括為憲政的基本理論，都是憲政基本理論的具體運用。於行政授權理論作為根據下，本人借鑒了權力憑藉和權變理論，認為在現代政府行政管理中，實際而有效的管理方法是要隨著現實環境的改變而相應作出調整，同時，在現實生活上，特區政府的行政管理正隨著經濟基礎及社會需求的改變而不斷地改變，從而使行政授權成為特區政府中的行政管理有用武之地。本文中，本人對澳門的行政授權的規範進行了初步分析，將現行的法律、法規納入行政授權規範的領域中，並指出特區行政授權的實踐方式及區分的不同標準、類型，申言之，根據行政授權所依據的法律標準和依據行政授權的客體標準，對行政授權進行了明確分類與比較。在對行政授權實踐分析的基礎上，本人認為澳門特區政府於行政授權存五個方面的問題：行政機關所作的授權過於分散、缺乏完善的行政授權標準、行政授權制度貧乏、授權機關未能適當的行使"收回權"、司法權對行政權控制較為薄弱。有關行政授權此一法律制度的完善問題，本人認為，作者分四個方面提出了對行政授權法律制度完善的基本構想：完善行政授權的標準和內容、完善行政授權主體及對象、完善行政授權的授權程序、完善行政授權控制與監督。
