This thesis is divided into seven chapters, The first chapter aims to present the intentions for conducting this research. It will also include an introduction to relevant literature review, as well as methodologies used during the research process, The structure and approaches of this thesis are indicated in the following summary of each chapter. Chapter two will intend to analyze Autonomy and Intervention in Marriage System Firstly, the evolution of the marital property in marriage system will be introduced Followed by an exploration of the evolution of marriage, Autonomy in Marital property and The Intervention of Marriage Partner. Then the question of “Why the Marital Property needs Intervention’ will be raised and analysed. Chapter Three and Four will analyse marital property from the presepective of history, a discussion will be held on the Roman law, Germanic law and the Canon law in particular, The findings of these two chapters points to serveral historical impacts that had influence on the evolution of marital property system. Chapter Five aims to analyse Autonomy and Intervention in Marital Property during Codification Period, This chapter also includes an evaluation of different characteristics of Marital Property in various countries and cultural context. Chapter Six then follows, which is devoted to the discussion of Autonomy and Intervention in Marital Property of Macau Law, corresponding to the subtitle of this thesis Chapter seven concludes with a discussion of findings of this research

本文分為七章·第一章主要用於說明寫作目的以及相關文獻的簡述等，論文的分析結構和思路如下，以對於婚姻與夫妻财產制度的自治與强制為主線，結合時間為主軸： 第二章為自由與強制之間的婚姻制度；首先引論婚姻制度的演變進行，探討婚姻的演變與屬性，再對婚姻中的自治進行分析，然後對婚姻的强制進行探討，從而導出夫妻财產中的强制。 第三章第四章為夫妻财產制度的歷史分析，從羅馬法時期的夫妻法定财產制到日耳曼法時期的夫妻法定財產制與約定财產制二元並行，教會法時期《聖經》中精神與理念的入駐，對婚姻自由的鼓勵以及限制，對夫妻财產制度產生了間接的影響。 第五章為法典化時期的夫妻财產制度，對一些國家法典中夫妻财產制度的自治與強制的特點進行了分析，引出第六章澳門法夫妻财產制度的自治與強制與强制，與文本副標題相呼應。 第七章為總結。
