Food safety and consumer protection : the perspective of China's food safety law

English Abstract

ABSTRACT Food is what matters to the people. What is the most basic material of the human survival and development, food is supposed to be safe from farm to dining. That is to say every link should be unharmed, including production, processing, storage, transportation, sale, cooking, eating. Food production and business operator shall provide safe food at least, which shall be their basic conscience; likewise, the consumer's the most basic selection criteria are to buy and eat the safe food. However, with the constant development of economy, people's living standards have improved, so the pursuit of food have been refurbished. Which, on the one hand, is to promote the introduction of new and high technology and popularization of use these technology in the field of food, as well as those boom the food market and rich peoplels diet life; on the other hand also provides a potential possibility to influence the factors of food safety food nutrition indexes not enough. Food production and business operators have the pursuit of the lowest cost and set other requirements aside, that is the subjective reason; and the level of human understanding of the objective world limitations, that is the objective reasons. Therefore, the both make the food safety problem solving need more related laws and regulations. Legitimate regulation, operators self-discipline and consumer awareness is called the three magic weapons to protect modern consumer rights and interests. In the progressive countries, these three plays its role and complement each other, constantly perfect, which is an important guarantee to solve the problem of food safety. Therefore, the importance of the role of legal regulation emphasized can be in a relatively short time to obtain the obvious positive effect. In recent years, the Chinese food safety incident has caused a serious loss to the Chinese government reputation and consumers' rights and interests. The regulation of food safety has been one of the urgent social problems of China. The food safety topic is becoming a hot spot, now it seems the enthusiasm also grew. Combined with the present stage of Chinese development analysis, consumer protection is of important significance. So the thesis, specifically, research on food safety from the perspective of consumers' rights and interests protection.
