論行政主導的法理基礎 : 以憲法上的行政保留原則為視角

English Abstract

ABSTRACT The existing research on Executive-Led System couldn't be effectively regarded as real scientific research, because it couldn't find its jurisprudential support. By tracing the theoretical foundation and support of executive-led system to the constitutional principle of administrative reservation, the author attempts to provide the executive-led system with solid normative foundation. In this research, the author uses the normative analysis method, the realistic interpretation method, historical analysis method and case study method. In chapter i, the author discusses the basic theory of administrative reservation, and concludes that administrative reservation is the constitutional guarantee in which the administrative could shape itself, and it's a problem of large or small rather than that of yes or no. in chapter ii, the author compares the executive-led system in comparative local government law, and finds the executive-led system is a general phenomenon rather than the sole one in SAR basic law, and it's the extension of administrative reservation. In chapter iii and iv, the author discusses the administrative reservation and executive-led system, and their significance and location in vertical power relations. In chapter v, the author provides executive-led system with normative foundation.

Chinese Abstract

摘要 目前學術界對行政主導的研究沒有得到法理支援,因此相關成果在一定程度上缺乏足夠的科學性,本文從憲法上的行政保留原则中尋找行政主導的理論基礎和支援,試圖為行政保留原則提供扎實的规範基礎。 本文綜合運用了規範分析法、現實主義的解釋方法、歷史分析法和案例分析法。在第一章中探討行政保留原则的基本法理,認為行政保留是受憲法保障的行政得以自主形成的空間,它不是有無的問题,而是範圍大小的問题。第二章在比较地方制度法中分析地方層面的行政主導,發现行政主導是一種普遍現象而非特別行政區基本法所獨有,並将其納為憲法行政保留的延伸。第三章和第四章分別分析特別行政區基本法中的行政保留舆行政主導,以及它們在縱向權力關像中的意義和定位。最終在第五章中為行政主導提供規範基礎。
