中國內地與澳門刑事司法互助若干問題思考 = Some issues of criminal judicial assistance between Mainland China and Macao

English Abstract

Macao's return to the motherland in the past 15 years, according to the policy of “one country, two systems” and “Basic Law of the Macao Special Administrative Region”, Macao is vested with independent legislative power, including that of final adjudication, Mainland China and Macao becoming to be two independent legal-region. With the extensive frequent exchanges, the crimes cross-legal region have increased significantly, and with the growth of crime, criminal judicial assistance is increasingly urgent. Although a lot of activities in the practice of criminal judicial assistance between Mainland China and Macao has carried out, but still stay on the mode of Mutual Case Assistance, and mostly was confined to the narrow sense of criminal judicial assistance, obviously that can’t satisfy the needs of realities, can’t better protect the legal rights and interests of people cross the two legal-region, because of the criminal judicial assistance will face more complicated legal problems, such as surrender of fugitive offenders, recognition and enforcement of criminal judgments, transfer and jurisdiction of convicted persons, transfer and jurisdiction of criminal proceedings etc., legalization are more and more urgent, but it is very regret that any criminal judicial assistance agreement isn’t signed until now. The object of this article is the emphasis and difficulty involved in the arrangement for mutual legal assistance signed by both sides, the main purpose is to provide support in theory for the arrangement will be signed successfully. In the field of criminal judicial assistance, for example, those principles of the international criminal judicial assistance, whether can apply to interregional agreement or not under the policy of “one country, two systems”, principle of double criminality, principle of Non-surrender own nationals (legal-region), principle of Non-surrender of political criminal, principle of Non-surrender of military criminal, principle of Non-surrender of death penalty’s criminal, principle of reservation of public interest, principle Some Issues of Criminal Judicial Assistance between Mainland China and Macao 2 of “Non Bis in Idem”. No assistance will be provided for judgment by non-prosequitur、the case exceeding the limitation or pardon prosecution, still including that the problem of the legal hierarchy of the interregional agreement in the legal order of the Macao Special Administrative Region. Specifically, this article is composed by the following five parts: 1. The Concept and the Scope of Criminal Judicial Assistance; 2. The Basic Principles of International Criminal Judicial Assistance; 3. The practices judicial and legal issues involved in the Arrangement for Mutual Criminal Judicial Assistance between Mainland China and Macao; 4. The issue of procedure of the conclusion -- The Legal Hierarchy of Arrangement for Mutual Criminal Judicial Assistance between Mainland China and Macao in the legal order of the Macao Special Administrative Region; In the light of the above analysis concerning problems, the author reaches the conclusions and the solutions, specific suggestion on establishing “Law of Procedure of the Conclusion of Arrangement for Mutual Legal Assistance”, refer to the application and legal hierarchy of international treaties in the legal order of the Macao Special Administrative Region, and it prescribes the contents of substantive law, subject to contract, executive subject, review of the negotiation, post-review of legislature, legal hierarchy, the procedure of promulgation etc. Key words: Criminal Judicial Assistance, Surrender of Fugitive Offenders, Recognition and Enforcement of Criminal Judgments

Chinese Abstract

澳门回归祖国 15 年来,根据“一国两制”方针以及《澳门特别行政区 基本法》,澳门享有独立的立法权和终审权,中国内地与澳门是两个独立的 法域。随着广泛频繁的交往,跨越两个法域的犯罪也大幅增加,刑事司法 互助也日益迫切,虽然实践层面中国内地与澳门已经开展了很多刑事司法 互助活动,但仍然停留在个案互助模式上,且大多限于狭义的刑事司法互 助,而这显然已经远远不能满足现实的需要,不能更好地保障两法域民众 的合法权益,因为刑事司法互助所要面临的实质法律问题更加复杂,例如 移交逃犯、刑事判决的承认和执行、被判刑人的移管、刑事诉讼移转管辖 等,法制化要求越来越紧迫,但令人非常遗憾的是至今两地仍未签署任何 此类协议。 本文针对的是中国内地与澳门签订刑事司法互助所面对的重点和难 点,主要目的是为了双方顺利签署协议在理论上提供支撑。例如在刑事司 法互助方面,国际刑事司法互助方面所遵循的原则是否可以在“一国两制” 下的区际协议当中适用,双重犯罪原则、本国(本法域)居民不移交、政 治犯不移交、军事犯不移交、死刑犯不移交、公共利益保留原则、一事不 二审原则、缺席审判不协助、犯罪已过追诉时效或者犯罪已经被赦免的不 予协助等,还有就是所签订的协议在澳门特别行政区的法律位阶问题。 具体来讲,包括以下五个部分的内容:1.刑事司法互助的概念、范围; 2.国际刑事司法互助的基本原则;3.中国内地与澳门刑事司法互助的司法 实践和法律问题;4.缔结程序问题--中国内地与澳门刑事司法互助协议在澳 门的法律地位。根据对上述问题的分析,得出笔者自己的结论和解决方案, 建议参照国际条约在澳门的适用方法和在澳门特别行政区内部法律秩序中 的位阶,澳门制定《区际协议缔结法》。当中就上述实体内容以及缔结主体, 执行主体,缔结过程的审查、采用立法会事后审查、位阶、公布方式等作 出具体规定。 关键词:刑事司法互助,移交逃犯,刑事司法判决的认可和执行
