Elective enforcement plays an important role of administrative law enforcement. It is closely related to the public rights, is also involved in law enforcement and justice, a great amount of researches on selective enforcement have been conducted by the domestic and foreign scholars, since the selective enforcement is not only closely related to the practical interests of the public, but also a direct way to let the public to feel the justice in administrative enforcement. This article started from the general theory of selective enforcement， by comparing domestic and foreign theories, summed connotation, performance and features of selective enforcement. Causes from the aspect through institutional factors, and environmental factors of selective enforcement, analyzed the current situation and harm of selective enforcement. For reducing selective enforcement, I’ll focus on law enforcement discretion achieve selective justice theory: "The legal authority to prohibit theory", "development of administrative rules theory", "return to the market theory", and then analyze the four ways to achieve justice of discretion: the correct handling of social and government the relationship between the reference system to establish a sound administration, the use of administrative law enforcement personnel training and improve the quality of the reasoning system.

选择性执法是行政执法中重要的法律现象。它与公众的切实利益 密切相关，同时也涉及行政执法是否正义，国内外学者对此现象都进 行了大量研究。 本文从行政执法与选择性执法的一般理论入手，通过比较国内外 理论，总结出行政执法中选择性执法的内涵、表现及特征。通过从制 度因素、环境因素等方面分析选择性执法的成因，指出选择性执法的 现状及危害。为防止和减少选择性执法，重点阐述实现选择性执法裁 量正义的相关理论：“禁止法律授权理论”、“制定行政规则理论”、“回 归市场理论”，进而分析出实现裁量正义的四大途径：正确处理社会 和政府之间的关系、建立完善行政基准制度、说理制度的运用、行政 执法人员素质的培训与提高。
