我國商事仲裁司法監督制度的現狀及完善 = The status and improvement of the judicial supervision system of commercial arbitration in China

English Abstract

As a solution of commercial disputes, commercial arbitration has been widely recognized and adopted by most of the countries in the modern world. China has also promulgated the "Arbitration Law" in 1994, and formally incorporated the commercial arbitration into our legal system. In recent years, the rapid development of arbitration breaks the domination of the litigation in the dispute settlement mechanism, and the existence of arbitration also provide the dispute parties an alternative way. But we also notice that compared with the foreign developed countries, the arbitration in China has many shortcomings and deficiencies as a result of the lateness of its appearance. Especially since China joined the WTO, the foreign civil and commercial affairs become more frequent in China, many aspects of our arbitration system are being challenged. So we need to adjust these aspects in order to suit the needs of the moment, the judicial supervision system of arbitration is just one of them. As we all know arbitration has distinguishing features such as flexible, professional, efficient and convenient, the civilian and autonomy of arbitration is the guarantee for arbitration to achieve these qualities. On the one hand, judicial supervision protects the fairness of the arbitration, but on the other hand, it also impacts the independence of the arbitration. The excessive and improper supervision will seriously damage the development of arbitration. So I choose this subject as the theme of this article, and the judicial supervision system of arbitration as the research object. The research is focus on the mode, standard and degree of the judicial supervision. The purpose of this article is to provide some ideas and suggestions for improving the system of judicial supervision of arbitration in China. The first chapter of the article introduces the history of the relationship between arbitration and litigation, and analyzes the significance and the theoretical basis of the need for judicial supervision of arbitration and the significance of judicial supervision system. The second chapter analyzes the disadvantages of judicial supervision of arbitration and its causes through the status of China's existing arbitration legislation, and make a research by comparing the legislative of other countries, and look for something that worth learning. Chapter three provides the overall idea and concrete proposals for improving the judicial supervision of the arbitration system on the basis of the preceding analysis.

商事仲裁作为一种解决商事争议的方式,已经被现代世界大多数国家普遍 认可和采纳。我国也于1994年制定并出台了《仲裁法》,将商事仲裁正式纳入到 我国法律体系中。近些年来,仲裁的快速发展更是打破了诉讼在纠纷解决机制 中一统天下的局面,为纠纷当事人提供了另一种选择。 但同时我们也看到,由于我国仲裁事业起步比较晚,仲裁立法相较于国外 发达国家存在很多不足和缺陷。特别是自中国加入WTO以来,我国对外民商事 交往愈加频繁,中国的仲裁体制在很多方面都受到了挑战,急需进行改革和调 整以应对现实的需要,仲裁的司法监督制度便是其中之一。众所周知仲裁具有 灵活、专业、高效、便捷等特点,而仲裁的自治性与民间性正是实现仲裁这些 特质的保证。司法对仲裁的监督与审查一方面保障了仲裁的公正性,另一方面 对仲裁的独立性也是一种冲击。过度的监督及监督方式的不当会严重损害仲裁 的发展,因此本文以此作为文章主题,以我国仲裁司法监督制度作为研究对象, 以司法监督的范围、模式、标准、程度等为中心进行分析和研究,以期为完善 我国仲裁司法监督制度提供一些思路和建议。 本文第一章首先从介绍仲裁与诉讼关系的发展历史入手,分析对仲裁进行 司法监督的必要性以及仲裁司法监督制度建立的意义及其理论基础。 第二章通过对我国仲裁立法现状分析我国现有仲裁司法监督制度的弊端及 其成因,并对国际立法及其他国家的仲裁司法监督制度立法进行比较研究,寻 找值得我国借鉴之处。 第三章在前文全面分析的基础上提出完善我国仲裁司法监督制度的构想和 具体建议。
