澳門中文立法語言研究 : 以回歸後的法律文本為例 = Analysis of the Chinese legal language of Macao SAR : base on legal documents announced after Macao's return to China

English Abstract

Legislative language is a branch of legal language. In the study of legislative language, choice of words and syntax are the major parts of it. After Macao’s return to China on 20 December 1999, the principle of ‘one country, two systems’ was put into practice, resulting that the legal system remained principally unchanged. Most national laws are not applicable in the special administrative region, hence a relatively independent legal system was formed. After reunification, laws are enacted by the law-making organ of Macau - Legislative Assembly and enacted in both Chinese and Portuguese; both versions are accorded equal status. Legislative language in Macau have changed from obscure to simple and plain, but it was inevitably affected by the original diction and syntax. To some extent, however, some features of the original texts remain, being rather localised and characteristic. The study of legislative language is an area still yet to be explored since the handover, and it is worth our while to study it further. The data of the thesis is based on the Chinese version of Macao Law that is released during 20 December 1999 to 31 December 2012. The author of the present thesis adopts both the qualitative and quantitative research method in the paper, studies from the aspect of ontology language and analyses based on the theories of forensic linguistics, corpus linguistics and traditional linguistics, etc. The author of the present thesis builds up a small-scale corpus by highlighting the participles and part of speech of the data. In order to take a glimpse of the features and styles of the contemporary legislative language of Macao, the author extracts the legislative phrases and idiomatic usage in legislative articles by counting on word frequency and doing analysis on the part of speech of the data. After the handover of Macao, the legislative language of Macao has moved from classical Chinese to contemporary vernacular style and so the concept of law is clearly and concisely presented. The contemporary legislative language is featured with v accuracy, preciseness, normative usage and decent expressions. By summarizing and investigating the legislative language, the thesis aims at having a comprehensive and accurate understanding on the Law of Macao Special Administrative Region, providing practical materials for sociolinguistics and shedding light on the researches of sociolinguistics.

Chinese Abstract

立法語言屬於法律語言的一部分。研究立法語言,主要是研究立法語言 的用詞和句式的規律及特點。1999年12月20日澳門主權回歸後,實行“一個 國家,兩種制度”的政策,澳門的法律制度基本不變。全國性法律絕大多數 在澳門並不適用,澳門形成了一個相對獨立的法律體系。回歸之後的法律由 澳門本地立法機關 - 立法會制定,且以具有同等法律效力的中、葡文雙語表 述。澳門的立法語言從艱澀難懂的翻譯文本向通俗易懂的淺白文本過渡,但 又不可避免地受原有法律的用詞和行文習慣影響,在一定程度上保留原有法 律語言特點,頗具地方特色。回歸後的立法語言至今仍是一個尚未完全開發 的研究領域,值得我們進一步探索。 本文選取1999年12月20日至2012年12月31日期間頒佈的澳門法律中文版 本,從語言本體入手,主要根據法律語言學、語料庫語言學和傳統語言學等 理論,採取封閉式的定量定性研究。本文通過分詞和詞性標注,建立一個小 型語料庫,繼而進行詞頻統計和詞性分析,並提取法律詞彙和慣用表達式, 借此略窺澳門現代立法語言的一些基本特徵和風格。回歸後的澳門立法語言, 從文言文逐步趨向現代白話文,以淺白簡練的詞語把法律思想和法律概念表 達清楚,具有準確明晰、簡潔凝練、嚴謹規範、莊重樸實的特點。本文對澳 門現代立法語言進行梳理和研究,旨在全面而準確地理解澳門特別行政區的 法律,也為社會語言學提供現實的材料,從而豐富社會語言學的研究。
