For many reasons, Chinese pharmaceutical enterprises fall behind multinational corporations (MNCs) on patent protect. This gap has already comprised huge challenge on survival and development of Chinese pharmaceutical enterprises. The weakness of patent work usually causes lack of protection on enterprise’s R&D results. Besides, the overlook of patent work also caused some Chinese pharmaceutical enterprises infringes others’ patent right and fail in patent lawsuits. Fortunately, some enterprises have already realized the importance of patent work. They bettered their patent management system, established their patent strategy and made obvious improvement. In order to investigate and summarize experiences of these successful enterprises, we chose six fine Chinese pharmaceutical enterprises as research objectives. We presented the current state of patent management system and patent strategy of these enterprises, investigated differences between Chinese enterprises and MNCs as well as factor that affects patent strategy. Based on our research, we also provided some practical advices on perfecting patent management system and formulating patent strategy for latecomer enterprises. Four conclusions were drawn from our research. Firstly, all six enterprises obtained decent amount of patent. However, the quality of these patents were still to be improved compared with MNCs. Secondly, all six enterprises had already establish similar patent management system with MNCs but still fell behind on human resource input and quality of patent staffs. Thirdly, six enterprises belonged to peripheral patent strategy model, some of which were transferring to me-too or me-better patent strategy model. They still had a long distance between basic patent strategy model which was implemented by NMCs. Fourthly, the most significant factor that affected enterprise’s patent strategy was R&D ability. Finally, we advised Chinese pharmaceutical enterprises to develop patent work institution, improve quality of patent work staff and advance the position of patent managing office. Chinese pharmaceutical enterprises should also strengthen patent information research, cautiously choose the pathway of patent development, precisely handle the timing of patent application, appropriately consider patent exchange and positively respond to patent lawsuit.

由于种种原因，中国制药企业的专利保护工作与跨国企业相比，存在巨大差 距。这种差距已经对中国制药企业的生存和发展带来严重的挑战。专利工作的薄 弱使得耗费大量人力物力得出的研发成果得不到应有的保护。对专利工作的忽视 还导致一些中国制药企业侵犯其它企业的专利权，在专利诉讼中败诉，从而造成 企业的巨大经济损失。令人欣慰的是，一些国内企业充分意识到了专利工作的极 端重要性，纷纷完善自身的专利管理体系，加强专利工作，明确自身的专利战略， 取得了明显的进步。 为研究并总结这些企业成功的经验，我们挑选六家优秀的中国制药企业作为 研究对象,通过案例研究的方法研究了这些企业在专利管理体系和专利战略方面 的现状，并寻找国内企业与跨国企业方面的差距以及影响企业专利战略的因素。 在此基础上，为后发企业在完善专利管理体系和制定企业专利战略方面提供可行 性的建议。 通过调研，得出了以下几点结论：(1)六家国内企业都拥有相当数量的专利， 但与跨国公司相比，专利的质量仍有待提高；(2)六家国内企业已经建立起与跨 国企业类似的专利管理制度，但在人力资源投入、人员素质和具体的专利工作上 与跨国企业还有较大差距；(3)六家国内企业均实施从属专利战略模式，部分企 业正在向 me-too 或 me-better 专利战略模式转型，但与跨国企业的基本专利战 略模式还有相当大的距离；(4)影响企业专利战略最主要的因素是企业的研发能 力。 最后，我们建议国内制药企业健全企业专利制度、提高专利工作人才素质、 提升专利部门的位阶，并在此基础上，加强专利信息调研工作、谨慎选择专利开 发路径、精确把握专利申请时机、适当考虑专利交易并积极应对专利诉讼。 关键词: 专利战略；专利战略模式；专利管理体系；中国制药企业
