關於中國內地食品安全法律制度若干問題的研究: 由安徽阜陽劣質奶粉事件引發的幾點思考

English Abstract

In these years, the food's safety is attracting more and more attention, The unsafe food are being revealed ceaselessly which brings a great fear to the public, This gives a negative impact on our society. Among all the cases, the most scurvy one was the Milk Powder Scandal. The legal weakness is being revealed gradually. The author took the Milk Powder Scandal as a typical case, and made a study to the problems in Food Safety system, The work is divided into 6 chapters. Chapter one, The author firstly briefly introduced the Milk Powder Case, then, had a further study to the typical problems that were found from this incident, This is one of the most typical cases in China Mainland weaknesses in food's hygiene administration are revealed. In addition, too complicated working process, uncompleted admittance system and are both problems exploded in this incident. Chapter Two, The shortage of the law and the problem in Food Security, At first, the author made an analysis on the four aspects of the present food security, A, The pollution in the resource. Because of the chase of financial reward, too much chemical products are added, which also leads to a big pollution . B, Counterfeits take a big possession of the market, It is very common that the illegal substances are added in food. C The confusion in prosecution, On one hand, many individual venders are disorderly set, which brought hidden troubles to the public, on the other hand, there should be more ensuring approaches in food transporting. D.Food safety incidents takes place very often. The author then gave a further analysis on the legal shortage. On one hand, the legal management needs to be improved, the boundary in punishment is not clear enough, the legal explanation is confusing. On the other hand, the uncompleted legal system led to many difficulties, e.g, the too narrow width of Food Hygiene, the lack of system and concord, etc. Chapter Three, the discussion in the concept of Food Hygiene and Standard. The author had a reference in the relevant concept and legislation, and also studied in the concept of Food Hygiene, which is paying more attention to the produce process, but the result is often neglected. In addition, the author concerned more about the weakness in security technique, including the double-work caused by uncompleted system un matching standard between national and international requirements. Chapter Four, The further study in the legislation principle. The author investigated the principle in Food Hygiene's Law Making, and studied the 5 characteristics, the Food Chain, Risk Study, the Principle Part in responsibility, Ascending Principle. Finally there is a study in the limitation in the lawmaking principle. Chapter Five, The discussion in law execution and supervision. Germany is the typical European member which has the most whole some structure, In the passage, the author firstly, introduced the formation of Food Hygiene and Supervision system is explained, and then, introduced Germany's law's execution, Finally, the detailed functions of the State Council and the problems in this field's are introduced. Chapter Six, The discussion in Food Hygiene system's development and consummation, Based on the Food Hygiene development in the future, .the author had a further discussion, In legal construction, the standard system should be set up, the legal responsibility should be put into effect, risk evaluation and recalling system should be built. In the administration field, through the administration and internal administration supervision. the checking system should be strengthened. Next, the management should be intergrated, Finally, there should be more experts involving into the campaign and Food Safety education. Chinese Abstract

近年来,食品安全逐渐成为新闻媒体关注的焦点,不安全的食品不断被媒体曝光,使广大人民群众感到惶惶不安,以致影到我国社会的稳定。其中以安徽阜阳毒奶粉事件造成的影响最为恶劣。食品安全事故时有发生逐渐暴露出我国食品安全法律制度的薄弱。笔者以安徽毒奶粉事件作为典型案例,考察中国食品安全体系在法律上的问题。本文共分六章。第一章:笔者首先简单介绍安徽阜阳毒奶粉案件的案情,接下来对该案背后当地食品卫生法制工作中暴露出的典型问题进行了分析。阜阳毒奶粉案是中国内地发生的众多食品安全事故中的一个具有典型意义的案件,该案集中暴露出当地食品安全主管机关在行政管理上存在混乱,由于多个主管机关职权重复交叉,导致集体不作为,问接扩大了该案的不良影响。另外,食品安全技术法规重复、市场准入制度不健全、缺少国际上广泛使用的食品召回制度,都是这一恶性案件暴露出的问题。第二章:中国食品安全问题与法律缺失。首先笔者分析了现阶段食品安全问顾比较集中的四个方面,一是农产品源头污染,由于过分追求经济效益,过量使用农药、化肥,不仅导致农产品中农药残留量超标,而且致使水土污染严重。是假冒伪劣的食品成品和半成品充斥市场。在食品加工制造过程中,非法使用和添加超出食品法规允许使用范围的化学物质以及使用劣质原料加工食品已经屡见不鲜。三是食品经营环节混乱,许多个体食品加工、制作点不经许可、不受监督,随意布设,给消费者日常生活的饮食安全带来隐患:另外,在食品流通领域,大多缺乏必要的冷藏措施、保鲜措施、食品安全检测手段和质量控制措施。四是食品安全事故时有发生。其次分析了我国食品安全法律制度上的缺失。一方面目前我国在食品安全立法上还比较落后,食品卫生法律法规存在的问比较多:处罚界定过于宽泛、处罚效力比较低、法律条文的逻辑性欠严密、文字表述指代不清、法律体系中缺少相对独立的食品召回制度、产品责任主体的限定不明确等。另一方面,由于食品卫生法律法规不规范给行政执法带来了问题,食品卫生法调整范围过窄、缺乏系统性和协调性,食品安全监控过程缺乏规范性和持续性。第三章:食品安全的概念和标准的探讨。文章中笔者参考了欧盟有关食品安全的概念和技术性法规,分析了我国的食品安全概念主要定义在食品卫生环节也就是说只重视食品生产的过程是否符合卫生标准,忽视了食品产品被人食用后产生的结果是否安全。另外,笔者着重分析了我国食品安全技术法规存在的弊端,包括标准体系结构不科学导致重复制标现象严重、因际标准的采标率偏低、因家标准的制定远远低于国际标准水平以及标准之间相互矛盾。第四章:食品安全法律的立法原则的探讨。本章笔者分析了食品卫生法的立法原则,并且着重介绍了欧美食品安全立法原则的五个特点,即从食物链、风险分析、责任主体、追溯原则到消费者权利保护。分析我国在食品安全法律立法原则上的局限性。第五章:食品安全法的执行和监督体制的探讨。德国是欧盟成员国中食品安全法执行和监督体系比较完善又具有典型性的国家。在本章中笔者首先介绍了我国食品安全执法和监督体系的构成,并对在食品安全监管中国务院下属各部门的职能作了详细的介绍。接下来介绍了德国的食品执法监督体系。随后分析我国在这方面存在的问题。第六章:发展和完善我国食品安全法律体系的探讨。本章笔者围绕未来我国食品安全法制建设和食品安全行政执法体系建设进行讨论。在法制建设方面,应当完善我国食品安全的标准化体系、实现经销实体的法律责任制、建立风险分析控制体系以及建立出行政部门监督的食品召回制度。在行政执法体系建设方面,首先,通过采用行政法制监督和行政内部监督的方式,加强对食品安全主管机关及其工作人员行政不作为的监督机制。其次,建立较为完善的食品安全应急处理体系。再次,将食品安全主管机关的分散管理逐步向统一管理体系转变。最后,加强专家参与和食品安全法制宣传教育。关键词:毒奶粉、食品安全、探讨、食品安全法制建设、行政执法体系建设
