With the implementation of the open door policy and economic reform in China, the number of cases of cross border crime has increased in recent years. Many scholars and legal departments paid more attention to this kind of crime, such as the type and source of cross border crime. Victim as part of the criminology in cross border crime didn't attract people's attention up to now. The cause of this phenomenon was complexly, but with the closer relationship between mainland of China and Hong Kong Macau, victim will play an important role in cross border crime and legal assistance in criminal matters in the mainland of China, Hong Kong and Macao. This research began from the victim's eyes to understand cross border crime, include the type of victims in cross border crime, the character of this kind of victim. Compared with victim in common crime; the research of victim in cross border crime should combine with legal assistance in criminal matters. So the thesis then did some research about victim and legal assistance in criminal matters. Finally, the research brought out how to protect victim in legal assistance in criminal matters in the mainland of China. Hong Kong and Macao. 随着香港、澳门的回归，港澳地区和大陆之间的联系更加密切，涉及到三地之间的区际犯罪也日益增多，从而导致了区际犯罪被害人的产生。区际犯罪中的被害人，作为一种特殊犯罪的被害人，和其他犯罪被害人在类型、特征等方面都存在着较大的不同之处，因此本文首先从区际犯罪入手来研究这种犯罪中被害人的类型及特征。同时考虑到被害人问题不但涉及犯罪学、刑法学和刑事诉讼法学，而且还贯穿于整个刑事司法体系，是刑事司法体系中重要的组成部分，本文接下去分析比较了中国大陆、香港、澳门三地相关法律中有关被害人规定的异同点，并通过被害人视野对区际刑事司法中的刑事管辖权冲突给区际犯罪被害人造成的影响进行了分析。最后，本文探讨了区际犯罪被害人在区际刑事司法协助中的保护问题，包括被害人保护的原则、模式、具体内容等。对于目前学术界很少涉及的区际犯罪中地区被害人问题，本文也进行了初步研究。 关键词：区际犯罪；被害人；区际刑事司法协助；保护
